1. About these terms
These terms govern the relationship between SimiHome Inc. ("we," "us," "our"), the company operating the SimiHome.net platform at simihome.net, and agents who register to list properties on the platform ("you," "the agent"). By registering as an agent, you agree to these terms.
2. Eligibility and verification
To list on SimiHome.net you must complete identity verification (KYC), which includes providing your name, contact details, WhatsApp number, a government-issued photo ID, and a selfie. You confirm that all information you provide is accurate and that you are legally entitled to market the properties you list. We may approve, decline, or revoke verification at our discretion.
3. Listings
Listing properties on SimiHome.net is free. There are no contracts and no exclusivity — you may list the same properties elsewhere and may stop using SimiHome.net at any time. You are responsible for the accuracy of your listings, including price, location, availability, and property details. You must not post listings for properties you are not authorised to market, or listings that are false, misleading, or fraudulent.
4. Commission
SimiHome.net does not take any commission on your sales or rentals. Any transaction is between you and the buyer or tenant; we are not a party to it.
5. Leads
We may pass buyer enquiries ("leads") to you, including via WhatsApp, phone, or email. A lead is recorded when a potential buyer chooses to contact you — it reflects a buyer's intent to make contact, not a guaranteed conversation or sale. We do not guarantee any number of leads, enquiries, or completed transactions.
6. Content and permissions
You retain ownership of the photos, videos, and other content you upload. By uploading content, you grant SimiHome.net a non-exclusive, royalty-free licence to use, display, and reproduce that content for the purpose of operating and promoting the platform and your listings — including on the SimiHome website and on SimiHome's social media channels. You confirm you have the right to grant this licence and that your content does not infringe anyone else's rights.
7. Data protection
We collect and store your personal information and verification documents to verify your identity and operate the platform. We store verification documents securely and limit access to authorised administrators. We retain your verification documents for as long as your account remains active, after which they are deleted within a reasonable period.
8. Your responsibilities
You agree to keep your listings current, respond to buyers professionally, and deal honestly. We may pause, remove, or delete listings, or suspend your account, if you breach these terms or if we reasonably believe a listing is inaccurate or fraudulent.
9. Future features and pricing
Listing is currently free. We may introduce optional paid features in future. If we do, we will give reasonable advance notice, and any features you currently use will not suddenly become paid without notice.
10. Liability
SimiHome.net is a platform that connects agents with potential buyers and tenants. We do not own, inspect, or guarantee any property, and we are not responsible for the outcome of any transaction, the conduct of any buyer, or any loss arising from your use of the platform, to the fullest extent permitted by law.
11. Termination
You may stop using SimiHome.net at any time. We may suspend or terminate your account for breach of these terms.
12. Changes to these terms
We may update these terms from time to time. We will notify agents of material changes.
13. Governing law
These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any disputes will be handled in the courts of Ontario, Canada.
